These Terms govern your use of the website and services at pitchera.ai (the "Service"). They are issued under Article 8 of the Polish Act of 18 July 2002 on the provision of services by electronic means.

2. Service description

pitchera.ai provides AI-powered analysis of pitch decks. You upload a presentation file and the Service generates an investor-readiness score, dimensional analysis, and a detailed PDF report with recommendations. Available tiers and their scope are described in the Service prior to purchase.

The output is informational and advisory. It does not constitute investment, legal, or tax advice and does not guarantee any fundraising outcome.

3. Technical requirements

  • An internet-connected device with sufficient bandwidth to upload PDF/PPTX files (5 Mbit/s recommended).
  • A current version of Chrome, Firefox, Safari, or Edge (no older than 12 months).
  • JavaScript enabled and session cookies allowed.
  • An active email address.

4. Acceptable use

You agree to upload only pitch deck files that you own or have the right to share. You agree not to upload malicious files, spam the Service, or attempt to circumvent security measures. You agree not to provide content that is unlawful, infringing, defamatory, or otherwise harmful. We reserve the right to refuse service to anyone who violates these terms.

5. Order and payment

  • An order is placed by selecting a tier, uploading the deck, providing an email and (for B2B) billing details, and completing payment.
  • The contract is concluded upon successful confirmation of payment by the payment processor.
  • Payments are processed by Stripe Payments Europe, Limited (Dublin, Ireland). Accepted methods include Visa and Mastercard cards.
  • We may use authorize-then-capture: funds are held at order time and captured only after the report is successfully generated. If generation fails, the hold is released without charge.
  • Upon request from a VAT-registered buyer, we issue a VAT invoice. EU intra-community B2B with a valid VAT number is invoiced under reverse charge (Art. 28b of the Polish VAT Act). Invoices are delivered electronically to your email; you consent to electronic invoices under Art. 106n(1) of the Polish VAT Act.

6. Service delivery

Delivery starts immediately upon contract conclusion. Standard generation time depends on the tier and is typically under 30 minutes; in exceptional cases (e.g. system load) it may extend up to 24 hours. The report is delivered by email containing a link to the web view and a PDF attachment. Server-side copies are automatically deleted 180 days after generation.

If, for technical reasons, the report cannot be generated, we will notify you and refund the full amount via the original payment method.

7. Right of withdrawal (consumers and entrepreneurs treated as consumers)

A consumer (and a sole proprietor entering a contract that does not have a professional character for them) has the right to withdraw from a distance contract within 14 days of its conclusion, without giving any reason and without incurring costs (Art. 27 of the Polish Act on Consumer Rights).

Loss of the right of withdrawal.Pursuant to Art. 38(1)(13) of the Polish Act on Consumer Rights, the right of withdrawal does not apply to a contract for the supply of digital content not delivered on a tangible medium where performance has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal will be lost upon performance, and the trader has provided the consumer with confirmation of that consent. By placing an order and accepting these Terms, you give such consent and acknowledge that you lose the right of withdrawal upon delivery of the report.

Where withdrawal is still effective (i.e. before performance is complete), we will refund the amount paid promptly and no later than 14 days from receipt of your statement, using the same payment method. To exercise the right, send your statement to [email protected] or in writing to the address of business. The model withdrawal form is included in the Polish Regulamin, Annex 1.

8. Complaints

You may file a complaint by email to [email protected] or by post to the registered address. The complaint should include your name, the email used for the order, the order ID (if known), a description of the issue, and your preferred resolution. We will respond within 14 days; lack of a response in that period is treated as acceptance of the complaint.

Where the digital service is not in conformity with the contract, consumers and entrepreneurs treated as consumers may demand that conformity be brought about, or — where this is not feasible or would require disproportionate cost — a price reduction or contract termination (Art. 43h–43j of the Polish Act on Consumer Rights).

9. Out-of-court dispute resolution

EU consumers may use the European Commission's ODR platform at ec.europa.eu/consumers/odr and may also turn to local consumer ombudsmen and permanent consumer arbitration courts at regional Trade Inspectorates. Use of out-of-court resolution is voluntary and requires the consent of both parties. Our contact email for ODR purposes is [email protected].

10. Intellectual property

You retain full ownership of the uploaded pitch deck and all content within it. We claim no rights over your materials and use them solely to perform the Service. The generated analysis report is provided for your use under a non-exclusive, perpetual, worldwide license, and may be shared at your discretion. The Service's brand, layout, code, and prompts are our intellectual property and are protected by law.

11. Limitation of liability

The analysis output is informational. We do not guarantee any fundraising outcome. For users who are not consumers (and not entrepreneurs treated as consumers), our liability is limited to the amount paid for the relevant Service and excludes indirect, incidental, or consequential damages, lost profits, and reputational harm. This limitation does not apply to consumers and entrepreneurs treated as consumers, who are protected under applicable mandatory law.

12. Personal data

Personal data is processed in accordance with our Privacy Policy.

13. Changes to these Terms

We may amend these Terms for valid reasons (legal changes, scope of service, provider changes). Amendments take effect 14 days after publication in the Service. Orders placed before the effective date are governed by the previous version of the Terms.

14. Governing law and jurisdiction

These Terms are governed by Polish law. Disputes with users who are not consumers (and not entrepreneurs treated as consumers) are submitted to the court with jurisdiction over the place of business of the service provider. Consumers may use the general jurisdiction rules under Polish civil procedure and Brussels I bis Regulation (EU) 1215/2012.
